Competition Terms & Conditions
Last updated: 20 July 2026
These Terms and Conditions apply to all competitions, prize draws, instant-win promotions, free competitions and promotional prizes operated by Tech Wins LTD through www.techwins.co.uk.
Please read these Terms and Conditions carefully before entering. By submitting an entry, you confirm that you have read, understood and agreed to be bound by them.
1. The Promoter
The promoter is: Tech Wins LTD Company number: 17300404 Registered office and postal-entry address: 15 Chivington Close Solihull B90 4YS United Kingdom Email: info@techwins.co.uk Website: www.techwins.co.uk
References in these Terms and Conditions to “Tech Wins”, “the Promoter”, “we”, “us” or “our” mean Tech Wins LTD.
References to “Entrant”, “Customer”, “you” or “your” mean any person entering or attempting to enter a Competition.
2. The Competitions
Tech Wins operates promotional competitions through its website, including:
- standard end-draw Competitions;
- Competitions containing Instant Win Prizes;
- completely free Competitions; and
- random promotional checkout prizes, including the Mega Tech Pot.
Together, these are referred to as the “Competition” or “Competitions”.
Multiple Competitions may operate at the same time. Each Competition will have its own webpage containing the relevant details, which may include:
- the Prize or Prizes available;
- the entry price, where applicable;
- the maximum number of Entries;
- the maximum number of Entries permitted per Entrant;
- the opening and closing date or time;
- any Instant Win Prizes;
- whether a cash alternative is available;
- the method and expected date of the draw; and
- any Competition-specific conditions.
The information displayed on the individual Competition page forms part of these Terms and Conditions.
Where there is a conflict between these general Terms and Conditions and a clearly stated Competition-specific term, the Competition-specific term will apply to that Competition.
Tech Wins offers a paid online entry route and a free postal entry route for paid Competitions. Completely free Competitions may be entered using the method stated on the relevant Competition page.
The availability and price of Competitions are determined by Tech Wins and will be clearly displayed before an Entrant completes an online purchase.
Tech Wins does not guarantee that any particular Competition or type of Competition will always be available.
3. Eligibility
Competitions are open only to persons who:
- are aged 18 or over at the time of entry;
- are legally resident in the United Kingdom;
- are physically located in the United Kingdom when submitting an Entry; and
- are legally capable of entering into a binding contract.
Tech Wins may require proof of age, identity, address and eligibility at any time.
Employees, directors and officers of Tech Wins, and members of their immediate families or households, may not enter a Competition.
Any person professionally connected with the creation, administration or operation of a Competition may not enter that Competition.
Tech Wins may refuse or invalidate an Entry where it reasonably believes that:
- the Entrant is not eligible;
- the Entrant has provided false, incomplete or misleading information;
- the Entry was made using fraud, automation, manipulation or another prohibited method;
- the Entrant has attempted to interfere with the fair operation of a Competition;
- the Entrant has attempted to exceed an entry limit;
- the Entrant has created or used multiple identities or accounts to avoid a restriction;
- payment has been reversed, charged back or obtained without authorisation; or
- the Entry otherwise breaches these Terms and Conditions.
It is the Entrant’s responsibility to ensure that entering a Competition is lawful in their particular circumstances.
4. Skill or Knowledge Question
Entrants may be required to correctly answer a skill, knowledge or judgement question before an Entry is accepted.
The relevant question and available answers will be displayed as part of the online entry process.
Where a Competition requires an answer, an incorrect answer will not result in a valid online Entry.
Postal Entrants must include the answer to the relevant Competition question on their postal Entry where a question applies.
Tech Wins may change the Competition question for future transactions or Entries, but will not retrospectively alter a question that has already been answered as part of a completed Entry.
The presence of a question does not guarantee that the question alone satisfies every legal requirement applicable to prize competitions. Tech Wins also provides a free postal entry route for paid Competitions in accordance with Clause 6.
5. Paid Online Entry
To enter online, an Entrant must:
- visit the relevant Competition page;
- select the desired number of Entries, subject to any stated limits;
- correctly answer the Competition question, where applicable;
- provide the requested personal and contact information;
- agree to these Terms and Conditions;
- provide valid payment details; and
- complete payment before the Competition closes.
Entrants are not required to create a permanent website account unless the website states otherwise for a particular feature. However, Entrants must provide sufficient information for Tech Wins to administer the Entry and contact them if they win.
An online Entry is not complete until:
- the required information has been submitted;
- payment has been successfully authorised and received; and
- the Entry has been recorded in Tech Wins’ systems.
Tech Wins may send an email or display an on-screen confirmation following a successful Entry. Entrants should contact Tech Wins promptly if they believe payment has been taken but their Entry has not been confirmed.
Entries are subject to the availability of entry numbers and any maximum entry limit displayed on the relevant Competition page.
The price shown at checkout is the total entry price unless additional optional products or services are clearly selected by the Entrant.
Entry numbers may be selected by the Entrant or allocated automatically, depending on the format of the Competition.
Only Entry numbers recorded in Tech Wins’ Competition database will be included in a draw.
Entrants must check their details carefully before completing payment. Tech Wins will not be responsible for a failure to contact a winner caused by inaccurate or incomplete information supplied by the Entrant.
6. Free Postal Entry
Paid Competitions may also be entered by post without paying Tech Wins an entry fee.
Postal Entrants are responsible only for the normal cost of sending their postal Entry. First-class or second-class postage must be paid by the Entrant.
Postal Entries must be sent on an unenclosed postcard or card to: Tech Wins LTD 15 Chivington Close Solihull B90 4YS
Each postal Entry must clearly and legibly include:
- the Entrant’s full name;
- date of birth;
- full residential address;
- email address;
- telephone number;
- the exact name of the Competition being entered;
- the answer to the relevant Competition question, where applicable;
- a statement confirming that the Entrant has read and accepts these Terms and Conditions; and
- any other information reasonably required and clearly stated on the Competition page.
Unless a Competition page expressly states otherwise, each postcard will count as one Entry.
Only one postal Entry may be submitted on each postcard. Multiple postcards may be sent, subject to the same overall maximum entry limit that applies to paid online Entrants.
Multiple Entries sent together in one envelope will not be accepted.
Postal Entries delivered by hand, placed directly through the Promoter’s letterbox or sent by recorded, tracked, signed-for, courier or special-delivery services will not be accepted.
A postal Entry must be received, not merely posted, before the closing date and time shown on the relevant Competition page.
Tech Wins is not responsible for postal Entries that are delayed, lost, damaged, incomplete, illegible, insufficiently stamped or delivered to the wrong address.
Valid postal Entries will be processed and allocated entry numbers in the same Competition database as paid online Entries.
A valid postal Entry will have the same chance of winning the end Prize as an individual paid online Entry.
Where a Competition includes Instant Win Prizes, valid postal Entries will be included in the same Instant Win Prize allocation process and will have the same chance per Entry as paid online Entries.
Where a Competition or promotional period includes a Mega Tech Pot or another random checkout-style Prize, Tech Wins will provide a corresponding method of including eligible postal Entrants in the promotional Prize allocation process. A postal Entrant will not be disadvantaged solely because their Entry was submitted by post.
Tech Wins will not accept a postal Entry after all available Entry numbers have been allocated or after the Competition has closed.
Tech Wins may reject a postal Entry that does not contain all required information or does not comply with this Clause.
No acknowledgment of receipt will necessarily be sent for postal Entries. Entrants may contact Tech Wins to enquire whether an Entry has been processed, but Tech Wins cannot guarantee that enquiries made close to the closing time will be answered before the Competition closes.
7. Entry Limits
Each Competition may have:
- a maximum total number of Entries;
- a maximum number of Entries per Entrant; and
- additional transaction limits.
These limits will be displayed on the relevant Competition page.
Entry limits apply collectively across paid online and free postal Entries.
Tech Wins may invalidate Entries where an Entrant has exceeded a limit, including where multiple email addresses, telephone numbers, payment methods, names or addresses have been used to avoid the limit.
Where more than the permitted number of otherwise valid postal Entries is received from an Entrant, Tech Wins may accept the Entries received first and reject the remainder.
8. Competition Opening and Closing
Each Competition will open and close at the dates and times displayed on the relevant Competition page.
Unless otherwise stated, a Competition will close on the earlier of:
- the advertised closing date and time; or
- all available Entries being allocated.
Tech Wins will not extend an advertised Competition closing date.
If all Entries sell or are allocated before the advertised closing date, Tech Wins may close the Competition early and conduct the draw earlier than originally anticipated.
The Prize advertised for a Competition will be awarded regardless of the percentage of Entries sold or allocated, unless the Competition is cancelled under Clause 15.
No Entry received after a Competition has closed will be accepted.
Website countdown timers are provided for convenience. The official closing time recorded by Tech Wins’ systems will determine whether an Entry was received in time.
Tech Wins may temporarily pause the sale or processing of Entries where reasonably necessary to deal with a technical, security, legal or payment issue. A pause will not extend the advertised closing date.
9. Standard End Draws
After a Competition closes, a winning Entry number will be selected at random from all valid Entries received before the closing deadline.
End draws will normally be livestreamed through the official Tech Wins Facebook page.
Tech Wins will normally use the Google random-number generator to generate a potential winning number within the relevant range of Competition Entry numbers.
Before confirming the winner, Tech Wins will check whether the number generated corresponds to a valid and eligible Entry.
If the generated number:
- was not allocated;
- relates to an invalid, refunded or disqualified Entry;
- exceeds the final valid Entry range; or
- cannot validly be awarded under these Terms,
Tech Wins will generate another number until a valid winner is selected.
Tech Wins may use another fair and verifiably random selection method where Google’s random-number generator is unavailable or where Tech Wins reasonably considers that another method is necessary.
Tech Wins will retain appropriate evidence of the draw and the winning Entry.
Where there is a technical problem during a livestream, Tech Wins may take a short break while the issue is investigated and rectified.
Tech Wins will return to the livestream as soon as reasonably practicable after the issue has been resolved.
Tech Wins will not select or confirm a winner while a material technical issue is known to be affecting the integrity of the draw.
If a technical issue makes the result unreliable or impossible to verify, Tech Wins may void that attempted draw and conduct a replacement draw.
The reason for any replacement draw will be explained to viewers and recorded by Tech Wins.
Tech Wins’ decision concerning the administration of the draw will be final, provided that the decision is reasonable, lawful and consistent with these Terms and Conditions.
10. Instant Win Prizes
Some Competitions may contain one or more Instant Win Prizes.
The individual Competition page will state the nature and number of Instant Win Prizes available.
Instant Win Prizes will normally be allocated fairly and randomly to particular Entry numbers before or during the operation of the Competition.
Winning Instant Win numbers will be stored in a manner designed to prevent staff or Entrants from manipulating the outcome.
When an online Entrant receives a confirmed Entry number that matches an Instant Win number, the website will notify the Entrant that they have won or provide instructions for checking and claiming the Prize.
A winning notification is subject to verification of:
- the Entrant’s identity and eligibility;
- the validity of the Entry;
- successful payment, where applicable;
- compliance with these Terms and Conditions; and
- the absence of a technical or administrative error.
Postal Entries will be checked against the same Instant Win numbers when they are processed.
If a postal Entrant wins an Instant Win Prize, Tech Wins will contact them using the details supplied on the postcard.
An Instant Win Prize remains available to be won until:
- its winning Entry number is allocated to a valid Entrant;
- the Competition closes; or
- the Competition is cancelled.
Where a winning Instant Win number is not allocated before the Competition closes, the Prize may remain unawarded unless the Competition page expressly states that it will be awarded by another method.
Tech Wins will not falsely represent that an Entrant has won an Instant Win Prize where they have not.
Where an apparent Instant Win result is caused by an obvious technical or display error, Tech Wins may withhold the Prize while the matter is investigated.
If Tech Wins can demonstrate that no valid winning Entry occurred, the incorrect display will not create an entitlement to the Prize. Tech Wins will refund the affected Entry or provide an equivalent replacement Entry where appropriate.
11. Free Competitions
Tech Wins may occasionally operate Competitions for which no purchase or payment is required.
The entry instructions, eligibility requirements, Entry limits, closing date, selection method and Prize details will be displayed on the relevant Competition page.
An Entrant must follow the stated entry instructions for their Entry to be valid.
Unless otherwise stated, free Competition winners will be selected fairly and randomly from all valid Entries.
Free Competition Entries have no cash value and cannot be sold, transferred or exchanged.
12. The Mega Tech Pot
Tech Wins may operate a random promotional Prize known as the Mega Tech Pot.
The Mega Tech Pot may be awarded randomly in connection with an eligible transaction or Entry during the promotional period stated on the website.
The website will state:
- the value or nature of the Mega Tech Pot;
- the relevant promotional period;
- the Entries, transactions or Competitions that qualify;
- any applicable restrictions; and
- how the winner will be notified.
Unless otherwise clearly stated, completing a larger transaction or purchasing more Entries in a single transaction will not give an Entrant a greater chance per qualifying Entry than another Entrant.
Tech Wins will use a fair random process to determine when or to whom the Mega Tech Pot is awarded.
Eligible postal Entrants will be included through a corresponding free-entry process so that the Prize allocation system does not unfairly distinguish between paid and free Entries.
The visual appearance, animation or notification displayed during an online checkout does not itself determine the result. The result recorded in Tech Wins’ secure systems will be authoritative.
A displayed Mega Tech Pot win remains subject to verification under these Terms and Conditions.
Where a technical failure creates an incorrect Mega Tech Pot notification, Tech Wins may pause the promotion while the issue is investigated.
Tech Wins may require reasonable evidence that a winning transaction or Entry was genuine, valid and completed by the named Entrant.
13. Winner Notification
Tech Wins will attempt to contact each winner using the telephone number, email address or postal address provided with the winning Entry.
Tech Wins will normally begin contacting the winner within 24 hours of the draw or confirmed Instant Win, but this is not guaranteed.
Entrants are responsible for ensuring their contact information is accurate and kept up to date.
A winner must respond and claim the Prize within one year of Tech Wins first notifying or attempting to notify them.
Tech Wins will make reasonable attempts to contact the winner during that period.
If the winner does not respond within one year, refuses the Prize, cannot be identified, is ineligible or is disqualified, the winner will forfeit the Prize.
Following forfeiture, Tech Wins may:
- conduct a replacement draw;
- select another eligible winner using the original random method;
- return the Prize to promotional inventory; or
- deal with the Prize in another reasonable and lawful manner.
Tech Wins may publish a notice requesting that an unidentified or unresponsive winner contact it.
Entrants should check their spam and junk-email folders and ensure that communications from Tech Wins are not blocked.
14. Winner Verification
Before releasing a Prize, Tech Wins may require the winner to provide:
- valid photographic identification;
- proof of age;
- proof of residential address;
- evidence that the winning Entry belongs to them;
- evidence that the payment method used was authorised;
- bank-account evidence for a cash Prize; and
- any additional information reasonably required to prevent fraud or comply with the law.
The details supplied during verification must reasonably match those supplied with the winning Entry.
Tech Wins may withhold delivery or payment until verification has been completed to its reasonable satisfaction.
Tech Wins may disqualify a winner where:
- the winner is under 18;
- the winner is not a UK resident;
- the Entry was made using false or misleading information;
- the Entry was obtained fraudulently;
- payment was unauthorised, reversed or charged back;
- the winner fails to provide reasonably requested verification evidence; or
- the winner has materially breached these Terms and Conditions.
Monetary Prizes will only be paid into a verified personal bank account held in the winner’s own name.
Tech Wins will not pay a monetary Prize into the bank account of a friend, family member, business, associate or other third party.
Prizes may not be assigned or transferred to another person except where Tech Wins agrees in writing or where required by law.
Tech Wins may make reasonable enquiries concerning suspected fraud, money laundering, identity misuse, payment abuse or manipulation.
15. Cancellation of a Competition
Tech Wins may cancel a Competition where it is reasonably necessary because of:
- a serious technical failure;
- fraud or attempted manipulation;
- legal or regulatory concerns;
- the loss, destruction or unavailability of the Prize;
- circumstances beyond Tech Wins’ reasonable control; or
- another circumstance that makes it impossible or materially unfair to continue.
Tech Wins will not cancel a Competition merely because an insufficient number of Entries has been sold.
If a paid Competition is cancelled, Tech Wins will refund all valid paid Entries.
Refunds will normally be issued to the original payment method.
Where a refund to the original payment method is not reasonably possible, Tech Wins may contact the Entrant to arrange another appropriate refund method.
Tech Wins may offer account Credit as an alternative, but an Entrant will not be required to accept Credit instead of a monetary refund for a cancelled Competition.
Free postal Entries and free Competition Entries do not carry a monetary refund entitlement.
Once all required paid Entry fees have been refunded, Tech Wins will have no further liability for the cancelled Competition except where liability cannot lawfully be excluded.
16. Prizes
The Prize for each Competition will be described on the relevant Competition page.
Tech Wins will take reasonable steps to ensure that descriptions and images of Prizes are accurate.
Images may be used for illustrative purposes. Minor differences in colour, specification, packaging or appearance will not invalidate the Competition where the Prize supplied is materially the same as the Prize advertised.
Tech Wins will award the advertised Prize or a reasonable equivalent of the same or greater value where the original Prize becomes genuinely unavailable for reasons beyond Tech Wins’ reasonable control.
A cash alternative will only be available where it is expressly stated on the relevant Competition page or subsequently offered by Tech Wins.
Where a cash alternative is available, its value will be stated on the Competition page or communicated to the winner before acceptance.
The winner may choose the advertised Prize instead of the cash alternative unless the advertised Prize has become genuinely unavailable.
Prizes are non-transferable and may not be exchanged for another product or service unless Tech Wins agrees otherwise in writing.
The winner is responsible for any personal tax consequences, insurance, registration, licensing, running costs or other expenses arising after the Prize has been transferred to them.
Nothing in these Terms affects any statutory rights the winner may have in relation to goods supplied as a Prize.
17. Delivery, Collection and Payment
Tech Wins will aim to deliver, make available for collection or pay a Prize within seven working days after:
- the winner has been successfully contacted;
- the winner has accepted the Prize;
- all required verification has been completed; and
- any necessary delivery or collection arrangements have been agreed.
The seven-working-day period is an operational target and may be extended where reasonably necessary because of:
- supplier or manufacturer delays;
- vehicle registration or transfer requirements;
- delivery availability;
- banking or verification delays;
- the winner’s availability;
- circumstances outside Tech Wins’ reasonable control; or
- the nature of the Prize.
Standard delivery of suitable Prizes to a UK mainland address will be free unless the Competition page expressly states otherwise.
Winners must collect large or specialist Prizes, including cars, vans and other vehicles, unless Tech Wins agrees otherwise in writing.
The collection location and available collection dates will be communicated to the winner.
The winner is responsible for their own travel and collection expenses unless Tech Wins expressly agrees otherwise.
Before collecting a vehicle, the winner must arrange any insurance, licence, tax or other legal requirement necessary to drive or transport it.
Tech Wins may require the winner to sign a Prize handover or receipt document.
Risk in a physical Prize passes to the winner when:
- it is delivered to the winner or their authorised recipient; or
- the winner takes possession of it on collection.
Ownership will pass upon completed delivery or collection, subject to any registration or transfer requirements.
Cash Prizes will be transferred only to the verified winner’s personal bank account.
18. Storage of Prizes
Tech Wins may store a physical Prize without charge for up to 30 days after notifying the winner that it is ready for collection or delivery.
If the winner unreasonably fails to accept delivery or collect the Prize during that period, Tech Wins may charge the reasonable costs of continued storage, insurance and administration.
Any storage charge must be paid before the Prize is released.
Tech Wins will not impose storage charges where the delay was caused by Tech Wins or its supplier.
A failure to collect a Prize within 30 days does not by itself shorten the one-year claim period in Clause 13, but reasonable storage costs may continue to accrue.
19. Refunds
Entries are final and non-refundable once purchased, except where:
- a Competition is cancelled;
- Tech Wins has taken payment but failed to provide the Entry;
- an Entry is invalidated because of an error caused by Tech Wins;
- Tech Wins expressly agrees to a refund; or
- a refund is required by law.
An Entrant cannot cancel an Entry merely because:
- they have changed their mind;
- they entered the wrong Competition;
- they selected an incorrect number of Entries;
- they failed to win; or
- the Prize is no longer personally suitable for them.
Entrants must review their basket and Competition selection carefully before making payment.
Where Tech Wins issues a refund, the related Entries may be removed from the Competition and will no longer be capable of winning.
If a refunded or reversed Entry has already received a Prize, Tech Wins may withhold or recover the Prize where legally entitled to do so.
20. Account and Promotional Credit
Tech Wins may issue website account credit, promotional credit, bonus credit, refunded credit or Prize credit, together referred to as “Credit”.
Credit may only be used on www.techwins.co.uk in accordance with any conditions communicated when it is issued.
Unless Tech Wins expressly states otherwise, Credit:
- cannot be withdrawn as cash;
- cannot be transferred to another person;
- cannot be sold or assigned;
- cannot be used outside the Tech Wins website; and
- may only be used to purchase eligible Competition Entries.
Unless a different period is clearly stated when issued, Credit expires six months after the date it is credited.
Unused Credit will be removed automatically after expiry.
The Entrant is responsible for using Credit before its expiry date.
Tech Wins may reverse Credit that:
- was issued in error;
- was obtained through fraud;
- resulted from an Entry or payment that was subsequently charged back;
- was obtained by abusing a promotion;
- was duplicated because of a technical error; or
- was issued in connection with a breach of these Terms.
Where Credit was provided instead of a refund, Tech Wins will clearly state this and obtain the Customer’s agreement where legally required.
21. Payment Disputes and Chargebacks
Entrants should contact Tech Wins at info@techwins.co.uk before initiating a payment chargeback so that Tech Wins has an opportunity to investigate and resolve the matter.
Tech Wins may suspend an Entrant from entering further Competitions while a chargeback or payment dispute is being investigated.
Where a payment is reversed or charged back, all Entries associated with that payment may be invalidated.
If an associated Entry has won a Prize, Tech Wins may withhold the Prize until the payment dispute has been resolved.
Tech Wins may suspend or permanently block a Customer who has:
- used an unauthorised payment method;
- submitted a fraudulent chargeback;
- repeatedly submitted chargebacks without proper grounds;
- attempted to retain both a refund and a Prize; or
- otherwise abused the payment process.
Tech Wins may seek recovery of its reasonable losses and direct chargeback costs where a chargeback was fraudulent or deliberately dishonest.
Nothing in this Clause prevents a Customer from exercising legitimate rights through their bank, card provider or applicable consumer-protection law.
22. Publication of Winner Information
Tech Wins may publish limited information about a winner for the purposes of transparency and announcing the Competition result.
This information may include:
- the winner’s first name;
- the initial of the winner’s surname;
- the winner’s general town, city or county;
- the Prize won; and
- the winning Entry number.
Tech Wins will not publicly disclose sensitive information such as a winner’s full residential address, date of birth, bank information, identity-document information or private contact details.
Winners may be invited to participate in photographs, videos, interviews, Prize handovers or other promotional content.
Participation in promotional photographs, videos or interviews is optional and is not a condition of receiving a Prize.
Tech Wins will obtain appropriate consent before using a winner’s image, voice, testimonial or recorded interview for marketing.
A winner may withdraw consent for future use of optional promotional material, subject to the Tech Wins Privacy Policy and any lawful use that has already occurred.
Tech Wins may retain and publish the minimum winner information reasonably required to demonstrate that a valid Prize was awarded, subject to applicable data-protection law.
23. Personal Data
Tech Wins will process personal data in accordance with its Privacy Policy and applicable UK data-protection law.
Personal data may be used to:
- administer Entries and Competitions;
- process payments;
- prevent fraud and abuse;
- verify Entrants and winners;
- contact winners;
- arrange Prize delivery, collection or payment;
- maintain Competition and financial records;
- comply with legal obligations; and
- send marketing communications where valid consent or another lawful basis exists.
Tech Wins may share relevant personal data with payment providers, website providers, professional advisers, suppliers, delivery companies, fraud-prevention providers and authorities where reasonably necessary.
Marketing consent is optional and is not a condition of entering a Competition.
Entrants may withdraw marketing consent using the unsubscribe option in a marketing message or by contacting Tech Wins.
Entrants should read the separate Tech Wins Privacy Policy for further information about their data rights and how personal information is handled.
24. Website and Technical Issues
Tech Wins will take reasonable steps to keep the website and Competition systems functioning correctly, but does not guarantee uninterrupted or error-free access.
Tech Wins is not responsible for an Entrant’s:
- internet connection;
- device failure;
- browser incompatibility;
- email filtering;
- incorrect contact details;
- payment-provider failure; or
- failure to complete an Entry before a Competition closes.
Tech Wins may temporarily suspend access to the website to carry out maintenance, address security risks or correct technical problems.
Where a technical or human error affects a Competition, Tech Wins will take reasonable steps to restore Entrants, Entries and Prizes to the position they would have been in had the error not occurred.
Tech Wins may correct an obvious error in:
- Entry numbers;
- Prize descriptions;
- website balances;
- Credit;
- winning notifications;
- prices; or
- Competition data.
Tech Wins will not rely on an obvious error to avoid awarding a genuinely won Prize where the result can be reliably established.
Where an incorrect Prize is awarded because of a demonstrable technical or administrative error, Tech Wins may take reasonable steps to recover it and award it to the correct winner.
An Entrant who knows or reasonably suspects that a website error has occurred must not exploit or attempt to exploit it.
25. Acceptable Use
Entrants must use the Tech Wins website lawfully and only for personal, non-commercial participation in Competitions.
Entrants must not:
- use bots, scripts, automated purchasing tools or automated Entry methods;
- attempt to hack, disrupt or overload the website;
- interfere with another Entrant’s use of the website;
- manipulate an Entry, payment, draw or Prize allocation;
- create false identities;
- use another person’s payment details without permission;
- submit malicious software or harmful code;
- scrape or copy website data without permission;
- threaten, abuse or harass Tech Wins staff, suppliers, winners or other Entrants; or
- use the website for unlawful activity.
Tech Wins may suspend access, invalidate Entries or block a person where it reasonably suspects a breach of this Clause.
Tech Wins may preserve and disclose relevant evidence to law-enforcement agencies, payment providers, regulators or professional advisers where lawful and appropriate.
26. Intellectual Property
All intellectual-property rights in the Tech Wins website, branding, logos, graphics, videos, written content, Competition materials and software are owned by or licensed to Tech Wins.
Entrants may not copy, reproduce, distribute, modify, reverse engineer, commercially exploit or republish Tech Wins content without prior written permission.
Third-party trademarks and product names are used only to identify Prizes or their manufacturers.
Unless expressly stated, the manufacturer, supplier or owner of a third-party brand is not the promoter, sponsor or administrator of a Tech Wins Competition.
Facebook is not a sponsor of, and is not responsible for administering, Tech Wins Competitions. Entrants release Facebook from liability in connection with Competitions to the extent permitted by law.
27. Liability
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- breach of statutory rights that cannot lawfully be excluded; or
- any other liability that cannot lawfully be excluded or limited.
Subject to Clause 27.1, Tech Wins will not be responsible for losses that:
- were not reasonably foreseeable when the Entry was made;
- arise from an Entrant’s own act or omission;
- arise from inaccurate information supplied by the Entrant;
- are business or commercial losses suffered by an Entrant acting as a consumer;
- arise after a Prize has been delivered or collected, except where Tech Wins remains legally responsible; or
- result from events outside Tech Wins’ reasonable control.
Tech Wins is not responsible for the maintenance, insurance, use or operation of a vehicle or other Prize after ownership and possession have passed to the winner.
Subject to Clause 27.1, Tech Wins’ total liability to an Entrant who has not won a Prize will not exceed the total amount paid by that Entrant for the affected Competition.
Subject to Clause 27.1, Tech Wins’ total liability to a winner in connection with a Prize will not exceed the advertised retail value of that Prize.
Nothing in these Terms affects an Entrant’s statutory consumer rights.
28. Events Outside Tech Wins’ Control
Tech Wins will not be liable for delay or failure caused by events outside its reasonable control, including:
- power or internet outages;
- failures of third-party hosting, payment or communication services;
- severe weather;
- fire, flood or natural disaster;
- war, terrorism, civil unrest or government action;
- strikes or industrial disputes;
- supplier or transport failure;
- epidemic or pandemic restrictions; or
- failure of Facebook or another livestreaming platform.
Tech Wins will take reasonable steps to minimise disruption and administer affected Competitions fairly.
29. Complaints
Questions or complaints should be emailed to: info@techwins.co.uk
The Entrant should include:
- their full name;
- the relevant Competition;
- the date of Entry;
- their Entry or transaction details, where available; and
- a clear description of the issue.
Tech Wins will investigate complaints reasonably and may request further information.
Tech Wins will aim to provide a substantive response within a reasonable period, depending on the complexity of the complaint.
Nothing in this Clause removes any right the Entrant may have to pursue a complaint or legal remedy elsewhere.
30. Changes to These Terms
Tech Wins may update these Terms and Conditions from time to time to reflect:
- legal or regulatory changes;
- changes to the website;
- changes to Competition formats;
- fraud-prevention requirements;
- changes to payment or technology systems; or
- improvements to clarity and consumer protection.
The latest version will be published on www.techwins.co.uk and will show its most recent update date.
Changes will not normally apply retrospectively to an Entry already completed.
Where a material change must affect an active Competition, Tech Wins will only make that change where reasonably necessary and where it does not unfairly disadvantage Entrants.
Competition-specific terms should not be changed after a Competition begins except where required by law or where circumstances outside Tech Wins’ reasonable control make the change unavoidable.
31. General Terms
If Tech Wins does not immediately enforce a provision of these Terms, this does not prevent it from enforcing that provision later.
If any provision is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect.
An Entrant may not transfer their rights or obligations under these Terms to another person without Tech Wins’ prior written consent.
Tech Wins may transfer its rights and obligations to another company as part of a genuine sale, merger, restructuring or transfer of its business, provided that this does not materially reduce the Entrant’s rights.
These Terms, the relevant Competition page and any expressly incorporated policies constitute the agreement between Tech Wins and the Entrant concerning the Competition.
A person who is not a party to these Terms has no right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
Headings are included for convenience and do not affect interpretation.
Words in the singular include the plural and words in the plural include the singular where the context permits.
32. Governing Law and Jurisdiction
These Terms and Conditions and all Tech Wins Competitions are governed by the laws of England and Wales.
Entrants who live in England or Wales may bring proceedings in the courts of England and Wales.
